Whether Georgia works for you depends on how you earnTalk it through

Georgia can grant tax residency to a high net worth individual without the 183-day test (Tax Code Art. 34(6)). You must have more than GEL 3 million in proven property, or more than GEL 200,000 a year in income for the previous three years. According to secondary sources, the current rule also requires property in Georgia worth at least USD 500,000.

What the Tax Code says

Art. 34(6) of the Tax Code allows residency to be granted to a high net worth individual "under the procedure and conditions determined by the Minister of Finance of Georgia". The Tax Code does not set the conditions itself. It leaves them to the Minister. The Minister of Justice is not mentioned in the current text.

Art. 34(6^2) also lets the Minister of Finance define further cases and a procedure for granting residency to a foreign individual.

Who is a high net worth individual

The Tax Code takes the definition from the Law on Securities Market. Under Art. 2(58) of that law, a high net worth individual is a person "whose proven property is more than GEL 3 million or whose annual income is more than GEL 200 000 for the previous three years".

So there are two alternative tests:

  • proven property of more than GEL 3 million; or
  • annual income of more than GEL 200,000 in each of the previous three years.

The 2023 rule and its conditions

The detailed procedure is in a rule titled "About granting Georgian residency to a high net worth individual". An updated edition was approved by Order No 60, published on 2 March 2023 and in force from 15 April 2023. We could not read the order on the official legal database in English. The conditions below come from the BDO Georgia newsletter of April 2023, which matches a summary by Andersen Georgia from February 2026.

Sources disagree on who issued Order No 60. BDO says the Head of the Revenue Service issued it. The law firm REVERA says the Minister of Finance issued it, dated 1 March 2023.

According to BDO and Andersen, you must meet all of these:

  1. Be a high net worth individual under the definition above.
  2. Either hold a Georgian residence permit, residence card or citizen ID card, or show Georgian-source income of at least GEL 25,000 in the last tax year before you apply.
  3. Own property in Georgia worth at least USD 500,000 equivalent in GEL. This applies in all cases and was added from 15 April 2023.

Since 2023 you can apply in person or through an authorised representative. Before 2023 only a personal application was allowed.

How the application is handled

According to Andersen:

  • The Revenue Service, the state tax office, forwards a complete application to the Minister of Finance within 7 working days, with a proposal.
  • If something is missing, you have up to 30 days to fix it. Otherwise the application counts as withdrawn.
  • The status is granted per year and must be renewed every year.

REVERA adds two points about Revenue Service practice:

  • The Revenue Service reads "last tax year" as a calendar year. So a certificate based on wealth for 2023 could only be issued in 2024.
  • For property, it wants the nominal value plus a market valuation close to the filing date. For bank funds, a recent statement is enough.

How this relates to residence permits

A residence permit is one way to meet the second condition above. It does not make you a tax resident on its own. You still need the high net worth status and the property in Georgia.

The USD 500,000 property test is a tax rule. It is separate from the property thresholds in immigration law. A short-term residence permit needs property worth more than USD 150,000, and an investment residence permit needs property worth more than USD 300,000. Those permits give the right to stay. They do not give tax residency. See the property residence permit and the investment residence permit.

Who this route fits

The route suits someone with substantial assets who does not want to spend 183 days a year in Georgia, and who is willing to hold at least USD 500,000 of property here. It does not suit someone without property in Georgia, because the property condition applies in all cases.

Residency through this route gives the same tax treatment as residency through the 183-day test. Foreign-source income is exempt under Art. 82(1)(u), and Georgian-source income is taxed. See foreign income and Georgian tax. Being resident in Georgia also does not end your tax residency at home. See what Georgian tax residency does not solve.

Earlier rules

The original instrument was a joint order of the Minister of Finance (No 991) and the Minister of Justice (No 250) of 31 December 2010, "Approval of the Rule granting the Georgian residency to high net worth individuals". It is cited in a 2017 Revenue Service document hosted by the OECD. Older guides based on that order may describe conditions that no longer apply, such as the personal-application rule.

What is not yet established. We have not read the text of Order No 60 itself. Its issuer is disputed, and its conditions on this page come from BDO, Andersen and REVERA. We found no source for a government fee for this route, and no official processing time beyond the 7 working days Andersen reports for forwarding the file. The Tax Code text used here is consolidated to 15 October 2026. We have not checked whether the amendment of 15 October 2026 (Law No 1888-VIმს-XIმპ) changes Art. 34.
